How can you find the best whey protein?  How can you differentiate between high quality, clean, label congruent protein powder & junk protein? Reading this will make you more educated on Protein Supplementation for your own health, protection, and muscle gain than the best athlete’s & even the BIGGEST SUPPLIERS IN THE WORLD. Look at these 2 bottles I just photo shopped really quick below. Let’s just say they both state they have 23 grams of protein per serving. One has a Supplement Facts Panel & the other has a Nutrition Facts Panel. Which would you buy? What’s the difference? Isn’t it the same stuff?

But that’s a whole entire, birther-type, controversy for another day.

LET’S BEGIN THE HONESTY INDOCTRINATION: In order to find the best whey protein you need to know, there is a big difference between a whey protein supplement and a whey protein food. It is important to know that one is much higher quality than the other. Keep reading and I’ll give you the facts. The first step is to identify a whey protein supplement. It is easy to identify a whey protein supplement. Simply look at the front of the label of your whey protein and it should say “dietary supplement” on the bottom. However, because the supplement industry is filled with owners who have no clue what they are doing when it comes to labeling their supplements, turn to the back and you should be able to find the supplement facts panel. Not shocking though, as I can pull down off the shelf 10 powders at GNC, 9 will be wrong, maybe 10. Why is Common Company wrong? They put enzymes into this powder. They have added protease, a protein digestive enzyme. Enzymes are, according to the FDA, dietary supplements.

This Cell-u-crap product should actually be labeled as a dietary supplement and technically the FDA can make them re-label this product, and if they don’t comply they can make them do a recall. Wonder why the FDA hasn’t yet? Hmmm… BACK TO THE FACTS: As you can see on the labels I showed you, one clearly says, “Supplement Facts” and the other clearly says, “Nutrition Facts”. Weird right? Why if both products are whey protein, is one labeled supplement facts & the other nutrition facts? LABEL CLARIFICATION: If a product has a supplement facts panel it’s a dietary supplement by law and if it contains a nutrition facts panel it’s a food by FDA law. So what should a protein powder be labeled? Why are mostly all whey proteins labeled with a nutrition facts panel and my whey protein with a supplement facts panel? Well I can’t speak on behalf of Common Company; I can only make assumptions to their thinking. However I don’t want to single them out because they are not the only ones that label their whey protein powder a food product instead of a dietary supplement and then claims to have the best whey protein. Just go to your local GNC or supplement shop and start randomly looking at the back of protein powders, almost all have a nutrition facts panel. Again perplexing and I guarantee that if you were to ask your local vitamin shop owner or manager they will have no clue.

So what makes a company decide whether they are going to label their protein powder a dietary supplement or a food product? Well, I believe it all stems from the following 3 reasons:  willingness to be compliant with the FDA’s CFR 111’s, clever thinking, or ignorance.

How NOT To have the best whey protein

1.Willingness to be FDA GMP compliant

All companies that have their name and address on a dietary supplement must follow these rules. Dan Fabricant, head of the FDA’s dietary supplements until April 2014, said in a speech that he gave at an ingredient supply show, that 70%-80% of supplement companies still don’t follow the rules. It’s not only the company above that apparently has suspect protein, in my opinion, based on Fabricants statement, most supplement companies are not following supplement laws, which has no 3rd party analysis checking to see if their label matches their protein. Hence, they released their protein for sale to the public without verifying what is on the label is actually in the plastic container. Seems this company was found out through someone that privately 3rd Party tested their stuff. The company may have known, or may have not, but if they labeled their powder a supplement, and followed the supplement laws, they definitely would have known and never been in this situation, along with their loyal customers. This could, and in my opinion would, be the same case for every protein retailer. It isn’t surprising to me knowing the history of dietary supplements, the hooligans that are associated with the sports nutrition industry, and the products that they are marketing. It’s not the FDA’s job to TELL you to follow the new CFR 111’s, it’s your responsibility to do so. Kind of like paying your taxes. It’s not the IRS’ job to TELL you to pay your taxes. It’s your responsibility. If you don’t, you go to jail. If you are a company selling whey protein powder you should label it a dietary supplement. It’s your responsibility. If you don’t, at the very least, your protein powder is suspect, at the most you are stealing from customers, endangering consumers, & breaking the law. -Classification of Whey Protein Powder: A. Whey protein powder is what the FDA calls a b3 dietary ingredient, which makes it a dietary supplement.

B. Not only that, but according to the definition of a dietary supplement, (to supplement or increase in the diet) whey protein fits that definition to the “T”. One buys a whey protein to increase their protein intake, therefore it’s a dietary supplement. Thus I have given you two FACTUAL (NOT OPINIONATED) reasons why a company should label their whey protein powder a dietary supplement and give it a supplement facts panel, NOT a nutrition facts panel.

2. IGNORANCE

Some companies selling whey protein isolate and claiming they have the best whey protein are just ignorant to the FDA 111’s. They have no clue what they are and/or have never heard of them. An entrepreneur with a business idea, and some cash, or exprofessional bodybuilder (Gaspari, Coleman, Yates, Labrada, Cutler to name a few), or some investors, want to start a company and sell whey protein. They call up a “private label manufacturer”, get a price quote, have their label made by someone who has no clue about the regulations and the designer simply copies another whey protein label. In 8 weeks they have their whey protein powder labeled nutrition facts or supplement facts but have no idea why. I would guesstimate more than half of the protein powders sold today fall into this category. I can’t tell you how many times I get contacted here at ProteinFactory.com® with a guy that says, “Hey I want to private label some whey protein because I have a gym with 3000 members. Can I get a price quote on a 5lbs bottle of whey”. I say, “Sure thing, but I must advise you first that you need to have your SOP manual done BEFORE you start selling a dietary supplement.” And then they’re like…er, um…what’s that. Following the 111’s is very difficult. The FDA estimated the cost to be compliant could run between 20K and 100K (depending on the size of the company). However, this doesn’t mean that it doesn’t stop a business savvy person from manufacturing a whey protein powder with his new companies name on it. ANY contract manufacturer or private label manufacturer will take anyone’s money and make them a product. It’s not THEIR job to make sure the company that they are making the powder for is FDA compliant. One of the largest cheese companies in the world, owns the HUGE COMPANY that boasts the number one selling whey protein powder in the world. Whey comes from cheese (well sometimes milk) thus, it made sense that this LARGE cheese company purchased this HUGE (ON EVERY STORE SHELF) PROTEIN Company for 300 million dollars a few years back.

Quick Anecdote: Did you know? PROTEIN and SUPPLEMENT sales are VERY BIG BUSINESS, estimated to top over 6 Billion In Sales This YEAR!  Therefore is a company truly does have the best whey protein, they are making a lot of money.  Look at this HUGE Company. Their Protein you’ll see is labeled nutrition facts, not supplement facts.  And of course they claim they have the best whey protein.

Not only do they label it as nutrition facts, if you look in the ingredients, Aminogen is added, which is an enzyme, making this product in my opinion, clearly a dietary supplement. Could it be switching it to a supplement label and following the CFR 111’s would cost the company millions? FURTHER FDA MARKETING LAWS: In addition, look at the way this product is marketed. The FDA takes into consideration the way a product is marketed. It is sold as a recovery supplement, not a MEAL. If it was a meal it would be marketed as a food. This product is clearly marketed as a whey protein supplement, not a whey protein food. It has pictures of bodybuilders in the ads, it talks about recovery for pre and post workout, and mentions amino acids in the powder. Clearly, this is meant to “supplement” the diet. So the question remains, WHY on earth would they NOT label this a dietary supplement? Could it be switching to the CFR 111’s would mean a lot more hired labor, inspections and paperwork? Now I can’t speak about why this HUGE Company or any other company would label their whey protein with nutrition facts versus supplement facts, but I can tell you this. (And pay attention because this is important.

If the Whey Protein Powder is labeled with a Nutrition Facts Panel it is subjected to FAR LESS quality control manufacturing practices and regulations than a Whey Protein Powder labeled as a dietary supplement with a Supplement Facts Panel. The more tests to ensure quality, the more money it will cost to produce. Therefore, it costs a LOT LESS TO PRODUCE AND GET TO MARKET a protein powder with a Nutrition Facts Panel. Thus, creating a lesser quality, unreliable protein powder for the consumer (you), with a much higher profit margin for the retailer. “I am sure Protein Retailers wouldn’t want to make more profit at your expense.” There are two sets of regulations the FDA has. One I mentioned already called Part 111 “Current Good Manufacturing Practice in Manufacturing, packaging, labeling, or holding operations for dietary supplements. This pertains to dietary supplements obviously. The other set is called this, Part 110 “Current good manufacturing practice in manufacturing, packing, or holding human food”

What is the best whey protein isolate?

I think it’s smart to use the Protein tested with the much more rigorous, & thorough CFR 111 quality testing, to achieve the healthier, quality fed, more muscular body. Which would you choose? Furthermore, I count 16 subparts for the CFR 111’s. Now I compared the number of sections for the 110’s vs. the 111’s. The 110’s have 11 sections. The CFR 111’s have over 100!!!! That is over 10 times the amount of regulations that the FDA imposes for dietary supplements. That is over 10 times the amounts of checks and balances my company, the ProteinFactory.com®, must conduct to sell you my whey protein powder! For those of you with a bit of inclination you can obviously see where I am going with this. As you can see a company selling a whey protein and labeling it with a nutrition facts panel has 10 times less quality control checks than if they label a powder a dietary supplement!

AMAZING & DISTURBING at the same time! It’s OK to get pissed now. It’s OK to take your whey protein labeled a “food” product and throw it in the trash or give it to your friend whom you don’t like very much. Think it matters? Can you now see why a company would want to label their whey protein powder with a Nutrition Facts Panel instead of a Supplement Facts Panel? Do you know how much more time and money it costs to label a whey protein powder a dietary supplement vs. a food product? Look at all the sections I just pointed out in the 111’s vs. the 110’s. Thousands and thousands of dollars in testing, paperwork, lab work, man power, and time! Now if you’re a huge company selling whey protein, figure the costs to make a food product versus a dietary supplement. Like I have stated, it could cost millions of dollars! And unfortunately, who pays for the current “Nutrition Facts Label?” YOU!! You pay by getting a low quality whey protein that has not gone through the proper tests that a dietary supplement should go through to ensure its strength (protein levels), composition (to make sure it actually is whey protein), and purity (that it doesn’t contain anything else that shouldn’t be there). If you are a buyer of whey protein it’s clearly obvious that you should ONLY buy a whey protein that is labeled with a SUPPLEMENT FACTS PANEL. There is absolutely no rational reason why you WOULD want to purchase a whey protein powder food over a whey protein powder supplement. Why would you want to buy a lower quality tested whey protein powder that has gone through less good manufacturing practice regulations? So when deciding on who has the BEST quality of whey protein the first step is simply seeing if it’s a dietary supplement or not. However, the label really doesn’t mean jack shit if the company is just putting it there out of ignorance. The NEXT step is to ask to see the 3rd party lab analysis of the lot number that is on the bottle. Yes this 3rd party lab analysis is a requirement in the 111’s not the 110’s. If the company selling the whey protein supplement is following the 111’s they will have the 3rd party lab analysis. If not well.. …..you can make your own assumptions.
